    Purpose of the DOCA

    The purpose of the Recapitalisation DOCA is to provide further time for the Administrators to:
    • conduct further investigations into the Company’s business, property and affairs to form an opinion on the
    likely outcome to creditors in the event the Company is wound up in liquidation;

    The Administrators would have most likely already completed a thorough assessment and investigation into The Company by now you would expect or at least this process would be well advanced and in its final stages of evaluation ? Notice they say in the event that the Company is wound up so this doesnt appear to be a conclusive statement . Who are the Creditors and what is their connection with The Company ? Are they existing stakeholders in The Company and if so one would assume their intention and motive would be to try and find a solution to keep The Company intact or seek a form of recapitalisation .


    • progress the Company’s ongoing legal matters and/or progress the sale of the Company and its
    subsidiaries’ assets;

    • explore the possibility of a restructure and recapitalisation of the Company which may provide a more
    beneficial outcome for stakeholders that from the immediate winding up of the Company.

    What constitutes a restructure ? Could this statement be in relation to the restructuring of The Board or a restructuring of the total amount of shares on issue ? Does a recapitalisation of The Company indicate the possibility of funding occurring ?
