You would need to go after the "deep pockets", as the lawyers say. That's why I think Andrew Cole was so stupid to mention they had been working on this for 3 years, because OZL certainly has plenty of assets to go after. Who knows what would be revealed in the discovery phase of a case, but finding a law firm or litigation funder to run with it might be hard. They much prefer easy ones like AMP, where the admissions have already been made in public.
