We should note that this application does not contain a variation to the 5th permit year work program commitment. Which means in the event the first application is rejected and the second application is accepted, they still must undergo a 3D seismic in order to renew the permit. I think the reason for not including a variation to the second application is to make sure that an application gets approved at all costs.

Also, the announcement says: "BPH has advised that the NOPTA application extension to the permit terms for PEP11 is in the final phase of decision process and is now with the Joint Authority for decision". David Breeze is clearly leaving this as ambiguous to try to make it sound like "the NOPTA application" (which one the first or the second?) is in the final decision phase. Common sense would tell us this sentence is only referring to the first application. The second application would be expected to take the appropriate length of time in NOPTA as any other application would.
