I don't know whether to laugh or cry having read the 530pm Friday evening announcement.
The tactics of the government (as noted by many along the way), would appear to be, "we would like to say no (for political reasons only), but NOPTA has said Yes, so we will kick it down the road as long as possible and hopefully not actually have to make a decision"..... Sadly IMO is potentially even worse than Scomo's captains call, at least he was so delusional that is was obvious to blind Freddy (and Justice Jackson) that Scomo's rejection was severely tainted.
In the current situation we have the current minister(s), deliberately delaying indefinitely a process which is designed to be an administrative process where a government body reviews application against a set of criteria and makes a recommendation to an "authority" for sign off. It is hard to believe the process is intended to operate with the "authority" then producing 1600 pages of stuff to not even refuse the application but to perpetuate a delay.
My biggest concern is that the upcoming court date, whenever that may happen, is only designed to enforce the government to make a decision. So whilst at some point a decision will be made, if it is no, and the company and its lawyers believe we have been shafted for political gain...what next?
We have been already been to court and in effect it was agreed the government had been biased, so the refusal was overturned to be "reassessed" and here we are. NOPTA have reviewed the application twice and approved it on both occasions.
Is there actually a legal remedy that could drive a "yes" outcome? I am slightly concerned that any court remedy would be at best another "reassessment" which sends us around in circles for another year or two.......
As to the timing of the Friday evening announcement 2 business days after the court update. Clearly as I noted a couple of days ago it can't be "market sensitive" as it wasn't released two days ago. Is it market sensitive....well I guess not.....I have read it and are non the wiser as to whether it is good news, bad or otherwise?
I have my options paperwork to consider in the next couple of weeks and am now pretty much resolved to this is the most information that will be available to make a decision, oh well, looks like I will get out my favourite coin and give it a toss and hope for the best....That said anyone with BPH shares must have a bit (or more likley alot) of an interest in a flutter!
