the govt doesn’t need to run a defence. It’s up to us to try and convince the court to issue an order for the JA to make a decision.
the application itself is a long bow don’t you think?
usually an application for a judicial review is to have the court review a decision as per what your barrister friends told you previously.
here a we have made an application for a judicial review of the process by asking for an order compelling an authority to make a decision:
it’s a stretch . More designed to send a message that we will get on the front foot.
i think DB is hoping the govt throws in the towel and just processes the application one way or another.
