    Like you JD I'm not a lawyer however I do have considerable experience in a previous life operating within the Magistrates Court. I can absolutely confirm that at this low level judiciary all the magistrate ever applies is the rule of reasonableness.

    That is to say you take the offence apply the law and run an overlay of what is reasonable in that event to the layman.

    I'm not sure how that reasonable test goes as we move up the judicial system but I would hope it still applies in the higher court as it does in the lower ones.

    The evidence seems overwhelming in terms of a lack of reasonableness having been applied to this application from the moment it was submitted to current day practices. It would seem that DB has applied a slow burn tactic that whilst frustrating for SH's may prove to be the best and most effective course of action to take against these political crooks.....here's hoping.
