IMO
If i may expand on that act you quoted - it is applied when there is NO legal finding/ruling against the government - then you can sue the government under that act for compensation.
Our predicament is not covered under that act. We are in court and will remain there until this comes to an end - either by cancellation of the permit OR approval by the JA. If the permit is to be cancelled - IMO from what I have read - the government can only do so under Clause 229 of the OPGGS Act - National Interest. (This is on the basis that NOPTA has recommended APPROVAL. IF NOPTA has recommended REJECTION... then the Govt is laughing all the way to the bank) And if they go down the cancellation path - that clause states - Compensation must be paid (Ref clause 249).
AT this point in time - Govt can not - IMO - claim national interest to cancel... HELL its in the national interest to approve the permit!!
FEDs - JUST APPROVE PEP11 in accordance with NOPTA Recommendation!....
