The way I understand it is that Justice Jackson will consider the grounds for refusal as stated by Husic. If Justice Jackson agrees with Advent that they are NOT valid, then those reasons can't be used again. Anything not raised as grounds in this refusal will not be able to be taken into consideration in the redecisioing process. Therefore, win the case, approval must be granted, which is what happended with Pathfinder.
