Thanks FD. Yes I could have expressedit better. I said “may” but I agree it is very unlikely. RG has been disciplinedand not bought any PGH shares since the bid expired, and I agree he probablywill not do so now for all the reasons you say.
Also, on your second point(which I agree with), the 90% is only relevant as a CA threshold if he bids fromunder that level. If he gets over 90% before bidding (eg using the creep rule) he can’t use s661A and would need to try under the General Compulsory Acquisition” power in s664A, which for RG could be ever harder than the standard s661 route- as it requires an independent expert report using an IE appointed by ASIC rather than by the PGH Board .
