    The critical point is the principle of continuous disclosure. This duty requires a Board to immediately inform the market via the ASX of any information that has become available to it that a reasonable person would expect to have a material effect on the share price or value of the company should it be released.

    Such an announcement is described as being 'market sensitive'.

    As you would know, there are 2 classifications for ASX announcements: 1 price sensitive and 2.not price sensitive. A market sensitive announcement would have to classed as price sensitive, obviously - although the ASX makes the determination as to whether an announcement is price sensitive or not.

    That said, 12 types of announcements are always labelled as price sensitive and these include quarterly reports and other periodic reports.

    So, a market sensitive announcement (see the definition above) must be made without delay, but what if there is news but it is not market sensitive news? It might, if released, be labelled 'price sensitive'. It would likely to be so labelled if it related to new assays, for example. However, the company could choose, imo, to with-hold such news from being released. If it is not market sensitive, then it could wait until the next quarterly activities report to announce the assays or do it before then if the circumstances favoured that event.

    (a) The Company is committed to regularly communicating with shareholders in a timely, accessible and clear manner with respect to both procedural matters and major issues affecting the Company. To achieve this, the Company communicates with shareholders through a range of forums and publications.

    (b) The Board of the Company aims to ensure that the shareholders are informed of all major developments affecting the Company’s state of affairs.

    Note the word 'major'. So, if there is news that is not market sensitive but it is not considered to be major news, then the company could rightfully, under this charter, keep it 'in-house' for a while.

    I am of the belief that the assays for the 3 Bottletree holes have been with the company for some time but because they are not market sensitive and also not of a major nature, the Board is not legally compelled to release them. The 3 holes had been completed as at 29 November (see the Presentation picture) and the MD said at the meeting that the assays might be available in late Jan or early Feb.

    They will be released in due course though imo, as part of a bigger picture, still being developed.
