If I may GC, I thought the same thing when I read it. I imagine escrow moneys are not held or given over without conditions being met first e.g. It may be subject to a hearing decision upheld against Mylan. And / Or, timelines may be extended on the escrow deadline if a hearing of material value has commenced. In these scenario's Mylan might wait until the Hearing process is complete before making an offer to POH. Only IMO.
