I am confused by your post. I never said you could patent a game.
PLY are reliant on the provision of information from Team 17 with regards to sales relating to AoD. It is why developers/writers/authors are strongly encouraged to negotiate audit rights as part of their contract. It would not be the first time a publisher/distributor has tried to screw someone.
Hell, the movie studios still think Return of the Jedi never made a profit.
