Nonsense.

The Alita Administrators, not KordaMentha, were responsible for arranging the DoCA and the terms are absolutely not the same.

Even if the injunction was a "precedent", the complaint submitted by the plaintiff focussed on 2 elements that do not apply to the ALO DoCA.
One being that there was no sale process for Alita and the other that the timeframe for the second creditors meeting was truncated.

In the situation of AJM, KordaMentha did market AJM and it's assets resulting in the DoCA for ALO to be acquired by PLS, and in actual fact an extension of time was granted to hold the second creditors meeting for both AJM and the subsidiary ALO.

So neither complaint by the plaintiff in the case against the Alita DoCA is relevant to AJM.

As for PLS shipments; no they did not include any ALO shipments for their December qtr tally. They exceeded 70k dmt all on their own. The bulk carriers were well tracked on shipping threads.

Suggesting PLS may have counted 3 or 4 shipments that did not belong to them is absurd and basic research would have dispelled that hypothesis.

Your list of various offtake deals is little more than misdirection.
