I actually think the market pricing the stock at 6 cents is not very confident of a positive outcome for the CE Mark.
If the market and hence, investors were confident of a positive ruling the price would be higher IMO.
Hence, with a binary event if and it is a big IF the regulator grants approval the price should move up significantly. However, if as the market expects approval is not granted then the price may well drift lower but perhaps and it is a BIG perhaps maybe most of the downside risk has already been priced in. These are just my personal thoughts and like many here have been caught out by the negative regulator preliminary ruining.
As always DYOR with this very high risk stock with a binary outcome event in the wings and with a preliminary negative recommendation.
