I'd get all the facts before you go to the FMA. If you're going to do it, do it right. There was no court ruling, PK withdrew their application for judicial review because they had no evidence to support their bogus claim about more than minor effects to water. They had an expert, their expert got challenged by Waikato Regional Council, Hauraki District Council and NTL experts and ultimately the didn't have a leg to stand on.
What's the upshot of all of this? Yes, the comment from the PK chairperson is at very, very best a disingenuous comment and at worst... Well.. We'll have to see how it pans out won't we
