However, the directors believe it is probable that the Company will be successful in the arbitration and accordingly have prepared the financial report on a going concern basis.
The word "probable" used by the Board is significant here. POH have an offer from Mylan IMO but it won't be near what Mylan have in reserve as a result of the settlement of claims with Strides. Mylan would have a better idea than most of what the arbitrator is likely to award, so they would be happy to sit on their hands and take the chance that the award with not exceed reserves IMO. Im happy to wait for the arbitrator too. $60 mil looks better on the balance sheet than $10 - 15 mil.
