I don't know how the legislation is regulated in Australia, but in Germany it is enshrined in the Basic Law as follows:
In the freedom of the press, a fundamental distinction is made between expressions of opinion and statements of fact.
While free expressions of opinion are protected by the Basic Law, demonstrably false statements of fact are punishable by law (only a corresponding criminal complaint must be made):
