Have not seen any notices for Clarke ceasing to be a substantial holder. Believe he held 6 million shares, so expect that he still does.
Supreme Court is an expensive exercise just the cost of Lawyers and Barristers is high and then if you loose you have to pay the other parties costs as well as the debt, so must be a sizeable amount.
