Yeah the trust is the issue here, adding in "rounded down to the lowest A$0.001" into the prospectus that was never in the orginal terms and never approved by shareholders is down right fraud. I have notified the company here so if they dont act on it several laws are being broken (Directors’ Duty of Care and Diligence , Issuance of Securities Without Proper Approval, Directors’ Duty to Act in Good Faith in the Best Interests of the Company, Misleading or Deceptive Conduct , just to name a few.)
I want to see where this was in the original terms, and also what dates they used to calculate VWAP, because really as the share price low was only 0.006 over any month it means the VWAP can at very minimum be 0.006 and maybe higher than this.
I can get that, at the time, this deal may have been the only option available—desperation often leads to poor choices. But I must still question the negotiation skills and industry connections at play here, as the sheer incompetence of this agreement is nothing short of astonishing. It’s the kind of deal one might expect from a man negotiating with a gun to his head, except in this case, he appears to have handed over the weapon himself. That said, I’ll give credit where it’s due at least he’s had the conviction to put his own money on the line, fully aware of the grim terms he’s agreed to.
On the upside, Lind stepping in suggests they believe this is the bottom after all, they’re maxing out the rest of the allocation. But belief alone doesn’t move markets, and Lind is no charity.
What remains to be seen is their next move. I don’t know how they handled their last parcels, whether they dumped them on the market for immediate profit or held with intent— but I’ll be watching closely when these new shares are issued. If we see a surge in volume, we’ll have our answer. And now, we have 150 million shares in profit from 0.005 to contend with, adding to the 625 million or so at 0.008. That’s a monumental wall of stock to push through, and a wall that won’t be breached without some serious news to drive momentum.
