if Acadia is going to pull that card and upserp neuren commercially, they would have done so already in PWS as they have a PWS program in trials
if they try to run a faux ph1/2 in a new rare disease to disrupt NEU, they will have a tough time PR wise within the rare disease community. not a lawyer, and not sure if such a legal loophole exists, but imo, negligible risk it will be realised.
