There is precedent in companies having to offer to investors refunds if the CR was done with incorrect information or information that proved afterwards to be incorrect. Now I do not know how this will play out , as you don't , the ASX will look at this , and with their request for information on 5th October they are imo watching this space.
Another question you could ask , if AGY have companies lined up as you say , why keep QQ to this contract , just piss them off and move on.
This is going to get interesting , one way or the other.
