Under ASX rules , if the CR was undertaken with incorrect information , or information that proved to be incorrect ..AGY may have to offer the purchasers of the issued shares an out and refund the buyers their purchase price. A recent example of this was BAL which did a CR to purchase packing facility with Chinese approval , the Chinese revoked the approval after the CR and BAL had to offer purchases a refund.
This is a very delicate situation and could get messy quickly.
