If there is no agreement between FMS and BBIG for the supply of ore from PIOP to support the BBIG project, WHY hasn't FMS not corrected this misconception, and these conditions within this State Rail Act?
FMS is very clearly stated as the supplier of ore to the BBIG project.
If FMS is named in the State Rail Agreement, as the supplier of the ore - just what, if any, potential liability might FMS be exposed to, if no ore is supplied to the BBIG project?
What obligations or liability or even credibility and reputational implications, might FMS suffer, if this project fails to get off the ground?
I know FMS was not a signatory to this State Rail Agreement, but just what liability FMS be exposed to if this project fails to get off the ground?
The ore from PIOP is the core of the AGreement.
So if FMS has not corrected any misunderstandings about the role of FMS, or the fact that FMS does not have an Agreement to supply ore to the project, just where does FMS stand if things go pear-shaped?
For example, the Karratha Council and the WA Govt, plus the Federal Govt, are currently spending millions $ on developing the road between Karratha and Mt Tom Price. The stated reason to spend that money on the road, is to enable workers at the PIOP mine site to be bussed to PIOP.
So if the mine is not developed at PIOP, who will be to blame.
What about all the other contractors working on the BBIG project such as engineers,, mine camp providors, equipment suppliers etc - they will be expecting compensation from someone if the BBIG project, or ore from PIOP, is not provided?
The silence from FMS in not correcting the assertion that ore is to come from PIOP, could place FMS in a poor position if BBIG project falls over for lack of supply?
These are just potential issues for a cash poor company like FMS.
How would shareholders currently be able to contemplate these issues, and these questions, given the zero info we have been provided with?
Perhaps its a question that might be asked of the directors who are defending their seats on the board of FMS?
