So lets rephrase:

They have given no proof whatsoever of what they have at this point in time and yet continue to claim they are on the verge of mass production.
If that is not in fact true- which it hasnt been for years, despite their repeated very similar "on the brink of/imminent" announcements to the market - then I dont know what what else to call it but deliberate misrepresentation of facts.
