the attorney general’s department will have the final say if the matter is to be contested.
if the bundle is filed and served the applicant will then know exactly where they stand.
the respondent may not want to be put in a position whereby the applicant now refuses to mediate as they know that continuing to hearing would see an adverse outcome for the respondent.
