The question will be how stringently the AG looks at this case through the model litigant lens.

If we accept for the sake of this conversation that all this posturing by the ALP was political and aimed at getting them to the election with a denial decision, then it would also be fair to assume that legalities may have formed a secondary purpose to timing.

Now that the timing of the decision has been achieved by the ALP in so far as it has got them to the election, the AG may have no option but to withdraw this case.
