I don’t think we will experience the same issues and here’s why.
The ALP have rejected the permit on two reasons, public interest and financial capabilities. If those reasons are found to be unfounded by Justice Jackson then that’s it. There’s no more the ALP can do. They cannot go back and say well now we want to deny the permit because of these other three reasons we just came up with.
So by extension if the justice finds the reasons invalid the permit goes back to the JA for what can only be approval. I would also imagine that Advent will as part of the judgment request the permit be reassessed in a timely manner let’s say 45 days maximum.
Id also suggest that the caucus policy will be included in Advents defence and will not be privileged as it is already in the public domain.
If no bundle is submitted by the government by the 30th they will be found to be in contempt of court and its game over. I totally believe and expect the government to lodge by the 30th.
It really comes down to what you believe JJ will hand down and that depends on how you interpret the evidence before us.
