depends only one thing - what was agreed durring the sale of KSM. I doubt the buyer will forget to include the agreed royalty clause if that bit is the only motivation why to buy KSM in first place.
but if they do that silly mistake and buy KSM without the right from ASM to use the tech then ASM have them by you know what. Plus, ASM now has free money to build new plant in Oz.
