If the situation is that clear cut, there wouldn't be an appeal. The fact that Dan reckoned there is a case where HMX'S rights were disadvantaged by their land being taken away from them unreasonably. The government will now have to justify their decisions and if Dan reckoned that HMX has been unfairly treated then the legal process is the best way to deal with it which may take years to settle.
