Violation of Anti-Dummy Law is exactly that — the use of local nationals to simulate ownership when the real owners are foreigners in violation of the law
if that is admitted, then its a settled issue, there is a violation of the law
The evidence and the Court will decide if it was illegal or not
Galeo is out of the picture but only the Courts can decide if the simulation of local ownership is illegal or not.
But none of the corporate disclosures that I have read have disclosed the real issues.
It will be fine and dandy if material information was just properly disclosed
But its anyones call if there has been enough transparency here
If Galeo owes the money, go ahead and collect
Truth is that Court proceedings were initiated against Climaco even before chasing Galeo for money
Even the Final Award was not filed in Philippine Courts for over 2 years
Bottomline, the Philippines has not yet affirmed the Final Award
