As I understand it, the point of the Supreme Court case is to simply verify that due process has been followed in the original permitting case. It therefore wouldn't make sense for them to consider upcoming legislation into their decision making unless there in some issue of uncertain legality which may be clarified by the new legislation. The delay is far more likely to be due simply to case backlog, or just pure lack of urgency.
