One thing I know is that with litigation the pendulum swings and each party has a "high-5" day. NST had a "high-5" day in January. TBR/RND just want to be receiving "high-5s" when the litigation war ends, not the battles along the way.
And even if they don't succeed in the current litigation it will likely not be the last in this saga. I'm guessing new proceedings will follow after the results are known. AB has a reputation of having a very long memory, and for pursuing those that have wronged him for as long as it takes. It took over 15 years but AB received a record defamation payment against Terence McLernon https://thewest.com.au/news/wa/700000-award-as-judge-issues-online-defamation-warning-ng-ya-120406.
