I seem to recall there was an out in the original agreement that allowed EECP to walk away if the share price fell sub 8c.
Regardless, given the agreement was always that the obligation to take the stock was in the hands of EECP, the quarterly statements that have been put out for several quarters now claiming they have a finance facility in place to access $5mln have been misleading. NRZ cannot access capital as EECP have no obligation to buy the stock.
