danbradster, that's not how this case will be heard nor the eventual award made by the tribunal. The Thai Government has 100% denied expropriation of Chatree so will not have a right to subsequently confiscate it.
KCN will remain the landowner, have $100M worth of plant and equipment and also have the same existing rights to apply for ML. Once the dust settles you'd expect that it could be monetised, irrespective of the proposed royalty uplift (which can always be negotiated given its Thailand). Particularly if they could get it up and running again.
