The JV has the loan facility and is the only entity which can access the $40M. FBR only receives money from the JV as Hadrian X's are actually ordered.
FBR does not have access to the $40M to do as it pleases. The only money FBR will have access to is the relevant progress payments on the Hadrian X delivery.
