It applies only to those shares which have not already been held for 45 (47) days. In other words, if you hold 12,000 shares of which 10,000 have been held for 2 years (say) but the other 2,000 were bought just a week before the most recent ex date, the 45-day rule applies only to the 2,000. You can sell any or all of the 10,000 at any time and still retain your franking credits on those shares.
