Thankfully it looks like the patents cover all the building blocks of the memory cells - it effectively covers all the physics that dictate how the cells work.
because of this it effectively doesn't matter what the manufacturing processes or the geometries are - you'd still be breaching the existing patents if you got to something like their tech.
