While disclosure certainly fell short of "full and transparent", the signs have been pretty clear for a long time that the company was comprehensively failing to gain traction. How long had it been working to get that Thailand plant working to capacity? What about the endless stream of "improvements" that had to be made to the battery? How many different target markets had they attempted to break into and quietly dropped out of after a pilot installation or two? These red flags have been fluttering in the breeze for years.
And over the course of 2024 there have been wailing sirens and flashing red lights as well: the large and growing provision for warranty, and the capital raising that failed to raise enough to cover even one of the company's objections being the brightest and loudest warnings.
So it's a bit of a reach to say that there wasn't enough information to reach a negative conclusion about the company's prospects or the way it was being run. The information was there.
