It depends on how much publicity an incident gets.
If there are enough mum and dads for it to generate political heat.
If there are enough instos who got burned (see Porche v VW hedging).
ASIC is just there in case there is political heat and to throw the odd nobody on the coals to keep the fire burning.
They are under-resourced and next to useless.
