Maybe but any s/h worth his salt would be looking intently for an ann each day given the wording of the TH ann. If someone was not doing so, the chances are that it would not have any impact on them whenever the ann. So, to me, for all practical purposes - likely a shrug of the shoulders. Whether it was legally the right thing to do - up to the legal experts to sort out.
