They clearly dont wont the price moving up the way it has to use extinguishing terms like that
NXS could have said "Discussions are underway with parties relating to the Crux asset, and it would be premature to make an announcement at this stage"

Why take the ultra conservative approach? its an interesting question. are both sides looking to delay an announcement so that more buy orders can be filled by current executive backers? If RC backers want a higher % holding, it would be a higher premium to them as well if the announcement was more positive. looks like a down day tomorrow.
