I can't make a judgement as I am not a lawyer although it seems logical to me to assume that this is a risk that is increasing in probability as time goes on, more so if the shares plummet in the vicinity of $1 region as that is a lot of loss suffered as the screams will be all the more louder and the pressure on regulators increases. Having said that, GSW may emerge from suspension with ASX satisfied - although this may not save the shares from tanking. ASIC seems to let so many seemingly clear cases of misconduct of some sort go un-investigated that who knows what threshold it would take to get them to pursue something.
