I don't think they can just choose to remain in suspension. The ASX suspended them due to concerns with the auditor report:
The securities of Cann Group Limited (‘CAN’) will be suspended from quotation immediately under Listing Rule17.3, pending compliance with Listing Rule 19.11A (b) in relation to the disclaimer conclusion of theindependent auditor in its review of CAN’s half year financial report for the period ended 31 December 2023
So I assume it will come out of suspension when the ASX is satisfied with the response it received. Not completely sure of the process here.
