    Now I am a touch confused about this.

    Cape Lambert/Sage took a bunch of shares and gained effective control as part of a fee for a facility that covered the amount to be paid to the funder if CHM was found liable.

    They got their fee so how can the facility be withdrawn.

    Either they need to provide the facility or part there of or refund the fee.

    You cant get paid for something that never got provided.
