My understanding is that Corps law has broader definition of shareholder than just ordinary shareholders. As for creditor there is the small matter of the 285m owed to hybrid holders. I'm not a lawyer so let the courts decide.
My point is that merely this idea will not be accepted by the board because they may end up being sued. They wont do this especially since there is nothing in it for them as they own a minuscule amount of shares.
