I don't think this is the case. Be careful what you're suggesting, the last thing anyone here needs is a lawsuit.
Someone here said about 95% of biotechs fail. That figure is about right.
Heaps of biotechs look great from Phase I - people are after all, are often pouring millions into Phase II trials, so no one wants to blow money on anything that looks remotely like a loser.
Yet something like two thirds of Phase II trials fail and don't make it to Phase III. The odds are stacked against it. This isn't because of fraud, it's just science. A huge range of factors such as the placebo effect, unconscious bias from doctors, or sometimes just other random factors come into play. Rarely is it bullcrap and cheating like Theranos, but most of the time it's just science. This is the whole point of the whole point of trials, to get rid of all those other factors.
