Nope, they wouldn't double down and go to court if they weren't confident in enforcing the scheme. They ARE confident in receiving $7.40 come September, and they have case law in their corner (i.e zero historical precedence in Aus for litigating MAC clause of this nature). See commentary from HL and Jeremy on this. No guarantee, but the odds look good and current arb is probably too wide.
