If this was another takeover bid, do you really thing the major brokers are going to sit there and keep throwing out $3 shares for sale? They know exactly what's going on which is why it's not going anywhere above 3.

The point is, there is a best and final offer which the board has endorsed. Arbitrage funds are already doing their thing - which is why 65m shares have churned without the SP holding above $3.

Just use some common sense instead of letting your investment cloud your judgement.
