It is unlikely that a class action suit will be brought forward. The affected shareholders will get an amount that is insignificant, if anything, compared to what they will get if the $3.50 bid goes ahead.
To the extent that affected shareholders are still holding the shares, they would prefer not to add a contingent liability onto VOCs balance sheets as it makes it less attractive to the bidders.
