Refer to @setfire2thehive's post in the resource upgrade announcement thread. He got a list of responses from the company regarding these questions. From memory the negotiations with the local quarry operator are proving slow for the open pit portion. Worse case scenario was the company would have to resort you applying for a new permit which would just delay open pit operation to the end of the year. This is why they have proceeded with underground in the meantime. I'd say its not a big issue at all it just delays open bit operations slightly if the local quarry operators keep driving a hard bargain.
